Ezberle Kullanım Şartları

Bu şartlar, Ezberle mobil uygulamasını (iPhone, iPad, Mac ve Android) ve web.ezberleapp.com web uygulamasını (birlikte "Ezberle") kullanımınızı düzenler. Ezberle'yi kullanarak bu şartları kabul etmiş olursunuz.

1. Hizmetin tanımı

Ezberle, İngilizce, Almanca ve İspanyolca kelime öğrenimi için hazır kelime setleri, kendi kelimelerinizi ekleyebildiğiniz "Serbest Çalışma", aralıklı tekrar planı, kişisel analiz (Analizim), bildirimler ve kullanıcılar arası yarış özellikleri sunan bir destek uygulamasıdır. Ezberle bir eğitim kurumu değildir ve belirli bir sınav başarısını garanti etmez.

2. Hesabınız

  • Hesap oluştururken doğru bilgi vermeniz gerekir.
  • Şifrenizin ve hesabınızın güvenliğinden siz sorumlusunuz. Hesabınızın izinsiz kullanıldığını fark ederseniz bize hemen bildirin.
  • Kullanıcı adınız yarış sıralamalarında diğer kullanıcılara görünür. Başkalarını rahatsız edecek, yanıltıcı veya hakaret içeren kullanıcı adları kullanmayın.
  • Hesabınızı istediğiniz zaman uygulama içinden (Ayarlar) silebilirsiniz. Silme işleminin sonuçları Gizlilik Politikası'nda açıklanmıştır.

3. Satın alma ve ücretler

  • Ezberle'nin temel özellikleri ücretsizdir. Bazı özellikler ücretli olarak sunulabilir.
  • Satın almalar App Store veya Google Play üzerinden yapılır ve ilgili mağazanın ödeme, iade ve iptal kurallarına tabidir. Ödeme bilgileriniz bize ulaşmaz.
  • Tek seferlik satın alınan özellikler, hizmet sunulduğu sürece aynı mağaza hesabıyla kullanılmaya devam eder.

4. Kullanım kuralları

Ezberle'yi kullanırken aşağıdakileri yapmamayı kabul edersiniz:

  • Hizmeti hukuka aykırı amaçlarla kullanmak
  • Yarış puanlarını hile, otomasyon veya başka yollarla haksız şekilde artırmak
  • Başka bir kullanıcının hesabına izinsiz erişmeye çalışmak
  • Hizmete, sunuculara veya diğer kullanıcılara zarar verecek, hizmeti aşırı yükleyecek ya da güvenliği atlatmaya çalışacak işlemler yapmak
  • Uygulamayı, kelime setlerini veya içerikleri izinsiz kopyalamak, satmak veya dağıtmak

Bu kuralların ihlali hâlinde hesabınızı askıya alabilir veya kapatabiliriz.

5. İçerik ve fikri haklar

  • Ezberle uygulaması, tasarımı ve hazırladığımız kelime setleri bize aittir veya lisanslıdır. Size yalnızca kişisel ve ticari olmayan kullanım için sınırlı bir kullanım hakkı verilir.
  • Eklediğiniz kelimeler, notlar ve örnek cümleler size aittir. Bu içerikleri yalnızca hizmeti size sunmak için saklar ve işleriz.
  • Kelime setlerinde adı geçen Oxford 3000™, Oxford 5000™, Goethe ve benzeri ifadeler ilgili hak sahiplerine aittir. Ezberle bu kurumlarla bağlantılı değildir ve onlar tarafından onaylanmamıştır.

6. Üçüncü taraf hizmetler

Uygulama içinden erişilen sözlük siteleri (Tureng, Oxford, Langenscheidt, DWDS, dict.com, RAE, Diccionarios) ile Apple ve Google giriş hizmetleri üçüncü taraflarca sunulur. Bu hizmetlerin içeriğinden, erişilebilirliğinden ve kendi kurallarından sorumlu değiliz.

7. Hizmetin sunulması ve değişiklikler

  • Ezberle'yi kesintisiz ve hatasız sunmak için çalışırız, ancak bunu garanti edemeyiz. Bakım, güncelleme veya teknik sorunlar nedeniyle hizmet geçici olarak durabilir.
  • Özellikleri, kelime setlerini ve tasarımı geliştirmek amacıyla değiştirebilir, ekleyebilir veya kaldırabiliriz.
  • Bildirimler ve Analizim önerileri bilgilendirme amaçlıdır; zamanında ulaşacakları veya her durumda doğru olacakları garanti edilmez.

8. Sorumluluğun sınırı

Ezberle "olduğu gibi" sunulur. Yürürlükteki mevzuatın izin verdiği ölçüde; hizmetin kullanılmasından veya kullanılamamasından doğan dolaylı zararlardan, veri kaybından ve sınav sonuçlarından sorumlu değiliz. Tüketici mevzuatından doğan haklarınız saklıdır.

9. Uygulama mağazaları

Uygulamayı App Store'dan indirdiyseniz Apple'ın Standart Lisans Sözleşmesi (EULA), Google Play'den indirdiyseniz Google Play Hizmet Şartları da geçerlidir. Bu şartlar ile mağaza sözleşmesi arasında çelişki olursa mağaza sözleşmesi uygulanır.

10. Uygulanacak hukuk

Bu şartlar Türkiye Cumhuriyeti hukukuna tabidir. Uyuşmazlıklarda tüketici hakem heyetleri ve tüketici mahkemeleri dahil olmak üzere yürürlükteki mevzuata göre yetkili merciler görevlidir.

11. Değişiklikler

Bu şartları güncelleyebiliriz. Önemli değişiklikleri uygulama içinden veya e-posta ile duyururuz. Değişiklikten sonra Ezberle'yi kullanmaya devam etmeniz, güncel şartları kabul ettiğiniz anlamına gelir.

Ezberle Terms of Use

These terms govern your use of the Ezberle app (iPhone, iPad, Mac and Android) and the web.ezberleapp.com web app ("Ezberle"). By using Ezberle, you agree to these terms.

1. The service

Ezberle is a vocabulary study tool for English, German and Spanish, offering ready-made word sets, "Free Study" for your own words, spaced-repetition reviews, personal analysis (My Analysis), notifications and leaderboards. Ezberle is not an educational institution and does not guarantee any exam result.

2. Your account

  • Provide accurate information when you create an account.
  • You are responsible for keeping your password and account secure. Tell us right away if you notice unauthorised use.
  • Your username is visible to other users on leaderboards. Do not use offensive or misleading usernames.
  • You can delete your account at any time from within the app (Settings). What happens on deletion is described in our Privacy Policy.

3. Purchases

  • Ezberle's core features are free. Some features may be offered for a fee.
  • Purchases are made through the App Store or Google Play and are subject to that store's payment, refund and cancellation rules. Your payment details never reach us.
  • One-time purchases remain available with the same store account for as long as the service is offered.

4. Acceptable use

You agree not to:

  • use the service for unlawful purposes
  • inflate leaderboard scores through cheating, automation or other unfair means
  • try to access another user's account without permission
  • harm, overload or attempt to bypass the security of the service, its servers or other users
  • copy, sell or distribute the app, its word sets or content without permission

We may suspend or close accounts that break these rules.

5. Content and intellectual property

  • The Ezberle app, its design and the word sets we prepare belong to us or are licensed to us. You receive a limited licence for personal, non-commercial use.
  • The words, notes and example sentences you add remain yours. We store and process them only to provide the service to you.
  • Names such as Oxford 3000™, Oxford 5000™ and Goethe belong to their respective owners. Ezberle is not affiliated with or endorsed by them.

6. Third-party services

Dictionary sites opened from the app (Tureng, Oxford, Langenscheidt, DWDS, dict.com, RAE, Diccionarios) and Sign in with Apple / Google are provided by third parties. We are not responsible for their content, availability or terms.

7. Availability and changes

  • We work to keep Ezberle available and error-free but cannot guarantee it. The service may pause for maintenance, updates or technical issues.
  • We may change, add or remove features, word sets and design to improve the service.
  • Notifications and My Analysis suggestions are informational; we do not guarantee their timing or accuracy.

8. Limitation of liability

Ezberle is provided "as is". To the extent permitted by law, we are not liable for indirect damages, data loss or exam results arising from the use of, or inability to use, the service. Your statutory consumer rights are not affected.

9. App stores

If you downloaded the app from the App Store, Apple's Standard EULA also applies; if from Google Play, the Google Play Terms of Service apply. Where these terms conflict with the store agreement, the store agreement prevails.

10. Governing law

These terms are governed by the laws of the Republic of Türkiye. Disputes are handled by the competent authorities under applicable law, including consumer arbitration committees and consumer courts.

11. Changes

We may update these terms. Significant changes will be announced in the app or by email. Continuing to use Ezberle after a change means you accept the updated terms.
